Del-Air "Play It Cool" Promotion Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE, WIN OR CLAIM A PRIZE. A PURCHASE OR PAYMENT WILL NOT INCREASE A PARTICIPANT'S CHANCES OF WINNING A PARTICULAR PRIZE. VOID WHERE PROHIBITED OR RESTRICTED. PARTICIPATION CONSTITUTES A PARTICIPANT'S FULL AND UNCONDITIONAL AGREEMENT TO AND ACCEPTANCE OF THESE OFFICIAL RULES.

SUBJECT TO VERIFICATION AND COMPLIANCE WITH THESE OFFICIAL RULES, ALL PROMOTION PARTICIPANTS WILL WIN A PRIZE. ODDS OF WINNING THE GRAND PRIZE (DEFINED BELOW) ARE APPROXIMATELY 1 IN 100,000. ODDS OF WINNING A SECOND PRIZE (DEFINED BELOW) ARE APPROXIMATELY 1 IN 50,000. ODDS OF WINNING AN ADDITIONAL PRIZE (DEFINED BELOW) ARE 1 IN 2.

BY PARTICIPATING IN THE PROMOTION (DEFINED BELOW), YOU AGREE TO THESE OFFICIAL RULES (THE "OFFICIAL RULES").

1. Sponsor and Administrator

The "Play It Cool" Promotion (the "Promotion") is sponsored by DEL-AIR HEATING, AIR CONDITIONING & REFRIGERATION LLC (the "Sponsor"). For the purposes of the Promotion and these Official Rules, "Sponsor" shall also include all of Sponsor's affiliates and related companies and entities directly involved in the Promotion, including without limitation: Sponsor's parent(s), sister(s), affiliate(s), and subsidiary companies; retailers; franchisees; advertising, promotion and fulfillment agencies; suppliers of materials and services related to the Promotion; any other corporation, partnership, sole proprietorship or other legal entity directly involved in the Promotion; and each of Sponsor's and the aforementioned entities' respective owners, members, officers, directors, employees, agents, and other authorized representatives.

2. Promotion Period

The Promotion starts on May 1, 2026 at 8:00 a.m. EST and ends on December 31, 2026, at 11:59 p.m. EST (the "Promotion Period").

3. Eligibility

All participants must: (a) be at least twenty-one (21) years of age or older at the time of participation; (b) be a legal resident of Florida; and (c) own legal title to a residential dwelling unit in any of the following Florida Counties: Baker, Bradford, Brevard, Charlotte, Collier, Citrus, Clay, Desoto, Duval, Flagler, Hardee, Hernando, Hillsborough, Indian River, Lake, Lee, Manatee, Marion, Martin, Nassau, Orange, Osceola, Pasco, Pinellas, Polk, Putnam Saint Johns, Saint Lucie, Sarasota, Seminole, Sumter, Union, or Volusia (each, a "Participant").

The following individuals are also excluded from eligibility: (i) individuals included in the definition of the Sponsor, as well as all immediate family members (defined as parents, siblings, children and spouses, regardless of where they live) of such excluded individuals and all persons living in the same households as excluded individuals (whether or not related); and (ii) any individuals who have won a prize from Sponsor related to any other contest or promotion offered by Sponsor during the six (6) month period immediately prior to the commencement of the Promotion Period.

All applicable federal, state, and local laws and regulations apply. The Promotion is void where prohibited by law or otherwise restricted.

The limitations set forth in this Section 3 are referred to herein as the "Eligibility Criteria."

4. Overview

The Promotion is a scratch game, wherein Participants receive a scratch ticket and attempt to match three (3) icons that correspond to one (1) of three (3) Prizes (defined below). All scratch tickets are winners!

5. Prize Information

The scratch tickets will award the following prizes:

  • Grand Prize: One (1) Participant will be awarded a new heating and cooling system, valued at up to $25,000 USD ("Grand Prize"). The installation of the Grand Prize shall be performed by Sponsor at a Sponsor-owned business location of Sponsor's choosing located in the County of residence of the Grand Prize winner.
  • Second Prizes: One-hundred (100) Participants will be awarded a one-year "Precise Comfort Plan" membership, valued at $324.00 USD ("Second Prizes").
  • Additional Prizes: Additional Participants will be awarded additional prizes, which may include a(n): A/C tune-up, plumbing inspection, electrical inspection, Del-Air service discounts, backpack, Yeti tumbler, t-shirt, or gift card. ("Additional Prizes")

The Grand Prize, Second Prizes, and Additional Prizes shall be, collectively or individually, as appropriate, referred to herein as the "Prize(s)."

6. How to Participate

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE OR WIN. There are two (2) ways to participate in the Promotion:

  1. Schedule a Tune-Up: Participants who schedule an air conditioning, heating, plumbing or electrical Tune-up or inspection with Del-Air Heating and Air Conditioning during the Promotion Period will automatically receive one (1) scratch ticket.
  2. Alternative Method of Entry ("AMOE"): Individuals can participate without a purchase or payment of any kind by completing the required entry form, available online at: delair.com. Upon completion of the entry form, Sponsor will send the Participant one (1) scratch ticket via postal mail. No more than one (1) scratch ticket will be provided per address.

Limit one (1) scratch ticket per address only. MAKING A PAYMENT WILL NOT INCREASE AN ENTRANT'S CHANCES OF WINNING A PARTICULAR PRIZE. By participating in the Promotion and claiming a Prize, Participants confirm that they have read, understand and agree to abide by these Official Rules. Each Participant must meet the Eligibility Criteria listed above or such participation will be deemed void, and such Participant shall be ineligible to receive any Prize. All Prizes must be claimed within 30 calendar days after the conclusion of the Promotion Period.

7. Verification & Confirmation of Potential Winners

The scratch ticket will determine whether a Participant is the winner of a Grand Prize, a Second Prize, or an Additional Prize. Prizes may be claimed during a Del-Air service appointment, or by sending the original scratch ticket to DEL-AIR SCRATCH GAME, 1000 BUSINESS CENTER DR STE 3050, LAKE MARY, FL, 32746.

PRIOR TO RECEIVING THEIR PRIZE, ALL PARTICIPANTS ARE SUBJECT TO VERIFICATION BY SPONSOR (IN ANY MANNER IT MAY CHOOSE) AND THE DECISIONS OF SPONSOR ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. A PARTICIPANT IS NOT ELIGIBLE TO RECEIVE A PRIZE UNLESS AND UNTIL THE PARTICIPANT'S ELIGIBILITY HAS BEEN VERIFIED AND THE PARTICIPANT HAS FULLY COMPLIED WITH THESE OFFICIAL RULES AND HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE.

Participants may be required to successfully complete a Know-Your-Customer ("KYC") Verification process provided by the Sponsor to validate eligibility to participate before redeeming any Prize. This may include, but is not limited to, providing proof of a valid government-issued photo identification, proof of address, and validation of SSN.

Potential prize winners must comply with these Official Rules, and receiving a Prize is contingent upon fulfilling all requirements.

If Participants seeking to redeem their Prizes cannot be contacted, fail to properly execute and return any required affidavit/declaration of eligibility or liability/publicity release within the required time period (if applicable), fail to comply with these Official Rules, or if a Prize is returned as undeliverable, that potential winner forfeits the Prize.

8. Prize and Prize Redemption

The right to receive a Prize cannot be transferred or assigned.

All Prizes are subject to availability, and if a Prize cannot be awarded for any reason, Sponsor reserves the right in its sole discretion to substitute the Prize with one of comparable or greater retail value. No prize substitution is permitted, except at the sole discretion of the Sponsor.

Sponsor reserves the right to charge handling and/or payment processing fees for processing the redemption of Prizes.

Each winner is solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of the Prize. Each winner agrees and acknowledges that Sponsor may be required to withhold and remit a portion of Prize value to comply with applicable tax laws. Each winner also agrees to provide Sponsor with a valid social security number, or any other information Sponsor may require in connection with applicable tax reporting or withholding requirements or other laws or regulations.

All costs and expenses associated with Prize acceptance and use not specifically provided herein are the responsibility of the winner.

If you have been issued a Prize that does not belong to you, whether due to a technical error, human error or otherwise, the value of the mistakenly issued Prize will (without prejudice to other remedies and actions that may be available at law) constitute a debt owed by you to us. In the event of an incorrect Prize award, you are obliged to notify customer support at service@delair.com.

It is your responsibility to retain copies of these Official Rules.

9. General Conditions

Sponsor reserves the right to cancel, suspend and/or modify the Promotion or these Official Rules, or any part of the Promotion or these Official Rules, with immediate effect owing to circumstances outside its reasonable control and only where circumstances make it unavoidable if any fraud, technical failures or any other factor beyond Sponsor's reasonable control impairs the integrity or proper functioning of the Promotion, as determined by Sponsor in its sole discretion.

Any notice regarding cancellation, suspension and/or modification will be posted by Sponsor on delair.com. In the event of modifying the Promotion or these Official Rules, an Entrant's continued participation in the Promotion or acceptance of a Prize constitutes acceptance of the modified terms.

Any Participant posting or seen to be posting comments on Sponsor's social media pages or elsewhere during the course of the Promotion that are considered bullying, spiteful, or upsetting to other Participants or any other customers of Sponsor's, or directly aimed at Sponsor, will have their comments removed and will be disqualified from the Promotion. Sponsor reserves the right to alert the operators of any social media sites to any such behavior.

Any attempt to exceed the maximum number of entries per person is a violation of these Official Rules and may result in disqualification.

Participants assume all risk of lost, late, misdirected, incomplete, or illegible entry requests or Prize redemption documentation. Incomplete, corrupted, garbled, misdirected or otherwise illegible entry requests or Prize redemption documentation, or entry requests or Prize redemption documentation without contact information or that otherwise do not conform to the requirements of these Official Rules are void and will not be accepted.

Sponsor reserves the right to disqualify fraudulent entries or entries suspected of being fraudulent, as determined by the Sponsor in its sole discretion. All AMOE entry requests submitted become the sole property of Sponsor and will not be returned.

10. Limitation of Liability and Releases

BY PARTICIPATING IN THIS PROMOTION, PARTICIPANTS AGREE THAT THE SPONSOR HAS NO LIABILITY WHATSOEVER FOR, AND PARTICIPANTS SHALL HOLD HARMLESS AND RELEASE THE SPONSOR FROM ANY AND ALL LIABILITY FOR, ANY INJURIES, CLAIMS, LOSSES, DAMAGES, COSTS OR EXPENSES OF ANY KIND (INCLUDING WITHOUT LIMITATION (AND UNLESS PROHIBITED BY LAW), DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES) ARISING FROM, IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY (A) ENTRY OR PARTICIPATION IN THIS PROMOTION, INCLUDING ACCESS TO AND USE OF THE PROMOTION WEBSITE; (B) ANY CLAIMS BASED ON PERSONAL OR PRIVACY RIGHTS, DEFAMATION OR PRIZE DELIVERY; OR (C) THE ACCEPTANCE, POSSESSION, USE, OR MISUSE OF A PRIZE, INCLUDING BUT NOT LIMITED TO LIABILITY FOR PERSONAL INJURY, BODILY INJURY (INCLUDING WRONGFUL DEATH), DAMAGE TO PROPERTY, AND DAMAGE OR LOSS OF ANY OTHER KIND. THE SPONSOR IS NOT RESPONSIBLE FOR PRIZE QUALITY OR UTILITY.

THE SPONSOR IS NOT RESPONSIBLE FOR ANY UNDELIVERED CONTEST ENTRY REQUESTS, INCLUDING WITHOUT LIMITATION, ENTRY REQUESTS OR EMAILS THAT ARE NOT RECEIVED BECAUSE OF AN ENTRANT'S OR POTENTIAL WINNER'S PRIVACY OR SPAM FILTER SETTINGS WHICH MAY DIVERT ANY NOTIFICATION OR OTHER E-MAIL, INCLUDING ANY WINNER NOTIFICATION E-MAIL, TO A SPAM OR JUNK FOLDER.

Without limiting the foregoing, the Sponsor is not responsible for: (a) any incomplete or inaccurate information that is caused by Promotion website users, or by any of the equipment or programming associated with or utilized in the Promotion, or by any technical or human error which may occur in the processing of submissions in the Promotion; (b) lost, interrupted, or unavailable network, server, service provider, on-line systems, telephone networks or telephone lines, or any other connections; (c) the theft, destruction, loss or unauthorized access to, or alteration of, entries; (d) any problems with, or malfunctions or failures of, telephone networks or lines, computers or computer on-line systems, servers or providers, computer equipment, software, viruses or bugs; (e) garbled transmissions or miscommunications; (f) failure of any e-mail to be received by or from the Sponsor for any reason, including but not limited to traffic congestion on the Internet or at any website or combination thereof or technical incompatibility; (g) damage to a user's computer equipment (software or hardware) occasioned by participation or downloading of materials related to this Promotion; (h) printing, distribution, programming or production errors, and any other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise; or (i) technical, pictorial, typographical or editorial errors or omissions contained herein.

11. Governing Law / Disputes

Participants expressly consent and agree that: (a) any and all disputes, claims, and causes of action arising out of or connected with this Promotion, or any Prizes awarded, will be resolved individually, without resort to any form of class action, and exclusively by the courts located in Orange County, Florida; (b) any and all claims, judgments, and awards will be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorneys' fees; and (c) under no circumstances will Participants be permitted to obtain awards for, and Participants hereby waive all rights to claim, indirect, punitive, incidental and/or consequential damages, and/or any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Participants and Sponsor in connection with the Promotion, will be governed by, and construed in accordance with, the laws of the State of Florida without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida.

12. Damages and Disqualification

Sponsor may actively seek damages from any person acting in bad faith to undermine the legitimate function of the Promotion to the fullest extent permitted by law. You may be disqualified from the Promotion if you violate these Official Rules.

Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Promotion or to be acting in violation of these Official Rules or in a disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may be a violation of criminal and civil law and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law.

Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

13. Winner Information

A list of the winners may be obtained by sending a self-addressed stamped envelope to DEL-AIR SCRATCH GAME at 1000 Business Center Dr, Lake Mary, FL 32746.

14. Personal Information & Publicity

The Sponsor and its authorized agents will collect, use, and disclose the personal information provided by Entrant for the purposes of administering the Promotion and prize fulfillment. By entering this Promotion, Participants consent to such collection, use, and disclosure of Entrant's personal information as described herein and in the Sponsor's Privacy Policy at: delair.com/privacy.

Except where prohibited by law, by accepting a Prize, each winner hereby grants the Sponsor an irrevocable, perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the winner's name, the contents of any posts, and information about the Prize award, in any way, at any time, in any and all media, including without limitation, for use in advertising and marketing, without any additional approval or consideration. By accepting a Prize, the winner represents and warrants that he or she has the right to grant the foregoing license.
